Terms of Service

1. Introduction and Acceptance

Strategift ("Strategift," "we," "us," or "our") is operated by PT Tirtajaya Gemilang Interiorku, a company incorporated under the laws of the Republic of Indonesia (NIB 0706220066636), registered at Jl. Kesehatan No. 6, RT 5/RW 11, Kel. Gedong, Kec. Pasar Rebo, Jakarta Timur, DKI Jakarta 13760, Indonesia.

These Terms of Service ("Terms") govern your access to and use of the Strategift platform, including our website (strategift.com and its subdomains), dashboard, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Strategift is a Software as a Service (SaaS) platform that provides:

• AI-powered SEO automation for WordPress and other CMS platforms
• Article generation optimized for Google Search and AI Search (GEO/AEO)
• Google Search Console integration and analytics
• Keyword research and mapping
• Automated technical SEO audits
• Social media content automation (Threads, Instagram, Facebook)
• AI Search visibility tracking
• Brand DNA Engine for consistent content tone of voice

The Service is available through paid Subscriptions, currently offered as two plans, Starter and Pro, each available on monthly, 6-month, or annual billing cycles. Current features and pricing are shown at strategift.com/#pricing at the time of purchase.

3. Free Trial and Billing

New subscribers receive a 7-day free trial, no credit card required. No payment is collected unless and until you choose to start a paid Subscription. Subscription fees are billed in advance for the cycle you select and renew automatically at the then-current rate unless cancelled.

We may offer early-access pricing to initial customers. If we increase prices generally, your rate for your current billing cycle will not change; any new rate applies from your next renewal, and we will give at least 30 days' advance notice before a price increase takes effect on your account. Fees are non-refundable except as set out in our Refund Policy and Money-Back Guarantee.

4. Cancellation

You may cancel your Subscription at any time from your account settings or by emailing smile@strategift.com. Cancellation takes effect at the end of your current billing cycle; you retain access through the period already paid for, and we do not provide partial-period refunds for early cancellation outside of the policies referenced above.

5. Account Registration

• You must provide accurate, current, and complete information when registering
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized access to your account
• One account is for one business entity or individual

6. Content Ownership

Content generated by Strategift's AI using your brand data and keywords is your property. You retain all rights to that Content; Strategift does not claim ownership over Content created on your behalf.

The Strategift platform, dashboard, technology, and brand remain our intellectual property. You may not copy, modify, distribute, or create derivative works from them without our prior written permission.

7. Acceptable Use

You agree not to use the Service to create, publish, or promote content for, or on behalf of, any business or activity involving:

• Illegal drugs, narcotics, or controlled substances
• Illegal or unlicensed financial services, investment schemes, or scams
• Content intended to incite hatred, violence, or terrorism
• Counterfeit goods or infringement of third-party intellectual property
• Pornographic material
• Gambling or betting where not legally licensed
• Human trafficking or trade in protected/endangered species
• Weapons, military equipment, or explosives
• Any activity that violates the laws of the Republic of Indonesia or your own jurisdiction

You also agree not to:

• Attempt to reverse-engineer, decompile, or exploit the Service
• Use the Service for spam or black-hat SEO purposes
• Resell or redistribute access to the Service without authorization
• Exceed fair-use limits in a way that affects other users

8. Third-Party Connections and AI Content Disclaimer

The Service connects to third-party properties you authorize, including your WordPress site(s) and analytics accounts (e.g., Google Search Console, Google Analytics). You are responsible for the accuracy of any credentials or access you grant us, and for having the right to grant that access.

While we apply quality and relevance safeguards to AI-generated Content, we do not guarantee search engine rankings, traffic, leads, or any specific business outcome, since these depend on factors outside our control, including search engine algorithms that change over time. You are responsible for reviewing generated Content before it is published.

9. Payment Processing and Chargebacks

Payments are processed by our payment processing partners, currently Doku (for Indonesian Rupiah transactions) and, as it becomes available, Stripe. We do not store your full card or bank account details; that information is held by the payment processor under its own security standards.

If you believe you were billed in error, contact us first at smile@strategift.com before disputing a charge with your bank or card issuer. If a payment is reversed or charged back through your bank rather than resolved with us directly, we may suspend your account pending resolution, since such disputes are deducted from funds already remitted to us and cannot be reversed unilaterally on our side.

10. Service Availability and Disclaimers

We aim to keep the Service reliably available but do not guarantee uninterrupted access or 100% uptime. Scheduled maintenance will be announced in advance. Except as expressly stated in these Terms, the Service is provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability or fitness for a particular purpose. We are not responsible for downtime caused by third-party infrastructure we rely on (including our hosting, database, AI, and payment processing providers).

11. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or special damages, including lost profits or lost data, except where such limitation is not permitted by applicable law.

12. Indemnification

You agree to indemnify and hold us harmless from any third-party claim, loss, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms, your Content, or your violation of any law or third-party right.

13. Termination and Suspension

Either party may terminate this agreement as described in Section 4. We may also suspend or terminate your account immediately, with notice where practicable, if: you violate Section 7 (Acceptable Use); a payment is reversed or charged back as described in Section 9; we reasonably suspect fraud or abuse; or we are required to do so by law or by a payment processor.

14. Force Majeure

Neither party is liable for delay or failure to perform obligations under these Terms caused by events beyond its reasonable control, including natural disasters, pandemics, war, civil unrest, power or telecommunications failures, government action, or outages, delays, or disruptions caused by our hosting, database, AI, or payment processing partners.

15. Changes to These Terms

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice (by email or in-product notice) before the change takes effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Indonesia. In the event of a dispute, the parties agree to first attempt to resolve it amicably. If not resolved within 30 business days, the dispute will be submitted to the South Jakarta District Court (Pengadilan Negeri Jakarta Selatan), without prejudice to any mandatory consumer-protection rights you may have under the laws of your own country of residence.
